King’s attorneys request gag order in murder case

SARASOTA COUNTY — One of the attorneys for the man accused of abducting and killing Denise Amber Lee asked a judge to ban everyone involved in the case from talking to news media.

The more information released about Michael L. King, 36, the harder it will be for King to get a fair trial, assistant public defender John Scotese wrote in a motion filed late Thursday.

“The very nature of the objectionable information now being released in news article after news article serves only to increase the likelihood that the defendant’s right … to a fair trial will be violated,” the motion states.

Scotese is also asking the judge to keep secret for 60 days any information given to King’s public defenders.

Additionally, Scotese wants a judge to allow either prosecutors or defense attorneys to file a written motion asking the judge to keep secret specific information until the trial or the case is resolved.

The restriction has just been requested and is not in place now.

A judge will have to issue an order prohibiting the release of information after a hearing, which has not yet been scheduled.

The motion specifically lists attorneys, parties, witnesses, law enforcement personnel and court personnel, who are connected to the prosecution or investigation of this case, as those who should be restricted from releasing information to any news media employee.

Her killer didn’t care about Denise’s rights (or the rights of her children, who will now grow up without a mother), and now we’re all supposed to feel bad that the man who allegedly killed her might not get a fair trial. It might make him look bad that he was seen at a gun range an hour before she was abducted. It might make him look bad that his neighbors say he was a nut. Whatever. He’ll get his trial, and if he’s innocent, then what is he worried about? Of course, the evidence is overwhelmingly against his being innocent. So I guess he’s worried. And rightly so. I think North Port may be about to see its first ever (at least in my memory, and I’ve been in this area for a long time) death penalty case.
