Jury begins deliberations in child murder trial

The jury went into deliberation in the second-degree murder and aggravated child abuse case against Holli Lynn Baty who has been on trial for three days for the death of Cheyenne Eairhart.

Eairhart, 4, was died Dec. 20, 2006, at her father, Wesley’s home, who was Baty’s boyfriend. She suffered a skull fracture, which a neuropathologist testified today was not from the result of a fall, as the defense has argued.

Baty, who also took the stand today, said, “I loved (Cheyenne) .She was a good kid,” adding she does not know exactly what happened. She denied any wrongdoing. She testified that Cheyenne was ill for several days before her death.

Neiropathologist – brain specialist Dr. Nelson — testified this afternoon the injury was not the result of a fall. He said the nature of the skull fracture is more consistent with a motor vehicle accident. It would take significant force to sustain this type of skull fracture. A simple fall would not do it, he said. The fracture went through two layers of skull bone.

If found guilty, Baty could face up to 25 years in prison.
